Kinder surprising

We were in a European sweetshop the day before Easter...well, I had to ask if they had Kinder Surprise eggs, didn't I? But Brits 'R' U.S didn't stock them.

They are very hard to come by in the US - in fact they have been banned here since 1997, because of the potential choking hazard of the very obviously non-edible toy in the centre of the chocolate egg. And [to quote Consumer Reports] "Kinder Surprise also falls afoul of a provision in the 1938 Federal Food, Drug and Cosmetic Act, which prohibits embedding "nonnutritive items" in confections."

Quite apart from the irony that pretty much every "confection" sold here is packed full of "nonnutritive items", it does strike me as bizarre that the same country that prohibits this "dangerous" candy egg still can't quite make up its mind to ban assault weapons.
